These Terms & Conditions (“Terms”) apply to purchases and orders placed with Kangan’s Bakery, operated by Real Rahat Bakers LLC (“Kangan’s Bakery,” “we,” “us,” or “our”), including orders placed through our website, in person, by telephone, electronically, or through another ordering method offered by us.

By placing or confirming an order, paying a deposit or other amount, or checking the acceptance box during online checkout, you acknowledge that you have reviewed and agree to these Terms.

1. Orders and Acceptance

All orders are subject to availability and acceptance by Kangan’s Bakery.

Submitting an order request does not guarantee acceptance. We may contact you for clarification regarding design, flavor, size, quantity, pickup or delivery date, customization, availability, pricing, or other order details before confirming an order.

An order is confirmed only after Kangan’s Bakery has accepted the order and received any required deposit or payment.

2. Custom Orders and Deposits

Custom cakes and other specially prepared products require a non-refundable 50% deposit to reserve the requested date and begin the order process.

The deposit is applied toward the total purchase price and also reflects, in part, the reservation of production capacity and the administrative, planning, design, sourcing, and preparation associated with a custom order.

Unless otherwise agreed in writing, the deposit is non-refundable to the extent permitted by applicable law.

The remaining balance must be paid by the deadline communicated to the customer. Kangan’s Bakery may decline to release an order until the balance has been paid in full.

Failure to make required payment when due may result in cancellation of the order.

3. Custom Designs and Inspiration Photos

We will make reasonable efforts to create a product consistent with the customer’s agreed theme, colors, design, and specifications.

Because cakes and bakery products are handmade, exact duplication cannot be guaranteed.

Colors, shades, proportions, decorations, placement, textures, lettering, flowers, toppers, edible images, and other handmade elements may vary from photographs or inspiration images.

Colors may also appear differently because of lighting, photography, computer or telephone displays, food-safe coloring, ingredients, and other production factors.

Photographs supplied by customers are considered inspiration or design references unless Kangan’s Bakery expressly agrees otherwise in writing.

Minor artistic variations that do not materially alter the agreed overall design are not considered defects.

4. Order Details and Written Confirmations

Customers are responsible for reviewing invoices, order confirmations, messages, and other written order details for accuracy.

Order-specific details confirmed in writing by Kangan’s Bakery, including size, flavor, design, date, quantity, and price, will control over earlier discussions or inspiration photographs concerning those particular details.

Customers should notify us promptly if a written confirmation contains an error.

5. Customer-Requested Changes

Requests to change an order must be communicated as early as possible.

Changes are subject to our approval, availability, production schedule, and any additional cost associated with the requested change.

Once ingredients, decorations, toppers, edible images, custom materials, or other supplies have been purchased or production has begun, certain changes may not be possible.

Approved changes that increase our material costs or labor may result in additional charges.

6. Cancellations

Customers should notify Kangan’s Bakery as soon as possible if they wish to cancel an order.

Deposits on custom orders are non-refundable to the extent permitted by applicable law.

Amounts paid above the required deposit will be evaluated based on the timing of cancellation, work already performed, materials or custom items purchased, production already completed, and other circumstances relating to the particular order.

Nothing in this section limits rights or remedies that cannot legally be waived.

If Kangan’s Bakery is unable to fulfill a confirmed order because of circumstances within our reasonable control and an acceptable alternative arrangement cannot be reached, amounts paid for the unfulfilled portion of the order will be refunded as appropriate.

7. Pickup and Inspection

Customers are responsible for picking up their orders at the agreed location, date, and time unless another arrangement has been confirmed.

Customers are strongly encouraged to inspect the order at the time of pickup.

Any visible issue involving the design, condition, quantity, spelling, decoration, or accuracy of the order should be brought to our attention before the product leaves our premises whenever reasonably possible.

If another individual picks up an order on the customer’s behalf, that individual will be treated as the customer’s authorized representative for receiving and inspecting the order.

8. Transportation After Pickup

Once an order has been picked up and leaves our possession, the customer assumes responsibility for its proper transportation, handling, and storage.

Cakes and desserts may be damaged by sudden braking, uneven surfaces, improper placement in a vehicle, excessive heat, direct sunlight, prolonged transportation, improper refrigeration, or improper handling.

Kangan’s Bakery is not responsible for damage occurring after pickup when the product was provided in satisfactory condition and the damage resulted from transportation, handling, storage, temperature, weather, or another circumstance outside our reasonable control.

9. Returns, Exchanges, Refunds, and Product Concerns

Because our cakes, desserts, baked goods, savory products, and other food items are perishable food products, food sales are generally final.

For food-safety reasons, Kangan’s Bakery generally cannot accept returned food products for resale and does not offer ordinary returns or exchanges after food has been purchased or picked up.

If you believe there is a quality, preparation, or order-accuracy problem, please contact us as soon as reasonably possible, preferably within 24 hours when the nature of the issue allows it.

We may request photographs, order information, or other reasonable information that allows us to evaluate the concern. When safe and reasonably practical, customers should retain the affected product until we have had an opportunity to discuss the issue.

Depending on the circumstances, Kangan’s Bakery may determine an appropriate resolution, which may include correction, replacement, store credit, partial refund, full refund, or another accommodation.

An accommodation provided in one situation does not create an obligation to provide the same remedy in another situation.

Nothing in these Terms eliminates or restricts any consumer right or remedy that cannot lawfully be waived.

Our Return Policy & Cake Care policy is incorporated into these Terms by reference.

10. Cake Care and Storage

Customers are responsible for following cake-care, refrigeration, storage, transportation, serving, and handling instructions provided by Kangan’s Bakery.

Temperature-sensitive products should be stored according to the instructions provided.

Kangan’s Bakery is not responsible for deterioration, melting, leaning, cracking, shifting, collapse, spoilage, or other damage caused by failure to follow provided care instructions or by circumstances outside our reasonable control after pickup.

11. Food Allergies and Dietary Requests

Our bakery is not an allergen-free facility.

Our facility handles ingredients that contain or may contain common allergens, including but not limited to:

● Milk

● Eggs

● Wheat

● Butter

● Food Colors

Cross-contact between ingredients may occur.

Customers are responsible for informing Kangan’s Bakery before placing an order of any allergy, sensitivity, or dietary requirement.

Although reasonable precautions may be taken when we are informed of a dietary request, unless Kangan’s Bakery expressly confirms otherwise in writing, we cannot guarantee that a product is completely free from a particular allergen or cross-contact.

Customers with severe or life-threatening allergies should consider this limitation carefully before placing an order.

12. Product Availability and Substitutions

Ingredients, decorations, flowers, toppers, colors, packaging, and other materials may occasionally become unavailable.

When reasonably necessary, Kangan’s Bakery may use a comparable substitute while attempting to preserve the overall appearance, quality, and value of the order.

If a proposed substitution would materially change the primary character or design of a custom order, we will make reasonable efforts to contact the customer before proceeding.

13. Online Orders and Customer Information

Customers are responsible for supplying accurate names, telephone numbers, email addresses, pickup or delivery information, order details, and other information necessary to process their orders.

Kangan’s Bakery is not responsible for delays or errors resulting from materially incorrect information supplied by the customer.

Customers should carefully review their order before submitting payment.

14. Prices, Taxes, and Fees

Prices are subject to change unless an order has already been confirmed at an agreed price.

Applicable sales taxes and other legally permitted charges or fees may be collected when required.

Any additional charge associated with an online or card transaction will be disclosed as required by applicable law before completion of the transaction.

15. Late or Unclaimed Orders

Customers are responsible for collecting orders during the agreed pickup period.

Because our products are perishable, Kangan’s Bakery cannot guarantee the appearance, freshness, quality, or condition of an order collected substantially later than the agreed pickup time.

Orders remaining unclaimed may be disposed of when reasonably necessary for food safety, quality, storage, or operational reasons.

Payments are not automatically refundable because a customer failed to pick up a completed order.

16. Events Beyond Our Reasonable Control

Kangan’s Bakery will not be responsible for delays or inability to perform caused by circumstances reasonably beyond our control, including severe weather, natural disasters, power outages, equipment failures, governmental actions, supply interruptions, emergencies, or other unforeseen events.

If such an event materially prevents us from fulfilling an order, we will make reasonable efforts to contact the customer and, depending on the circumstances, arrange a reasonable alternative such as rescheduling, substitution, store credit, or refund of the affected unfulfilled portion of the order.

17. Photographs and Portfolio Use

Kangan’s Bakery may photograph products we create and use photographs of those products for our portfolio, website, advertising, social-media accounts, or other promotional purposes.

We will not intentionally disclose a customer’s private personal information in connection with those photographs without permission.

18. Copyrighted, Trademarked, and Third-Party Designs

Certain characters, logos, trademarks, photographs, artwork, and designs may be owned by third parties.

A customer’s request for a particular design does not itself grant Kangan’s Bakery ownership of or permission to use third-party intellectual property.

Kangan’s Bakery reserves the right to decline or modify a requested design when we believe doing so is appropriate because of intellectual-property, licensing, production, safety, or other concerns.

19. Payment Disputes and Chargebacks

Customers who believe that a charge or order is incorrect are encouraged to contact Kangan’s Bakery promptly so that we have an opportunity to investigate and attempt to resolve the matter.

Nothing in these Terms prevents a customer from exercising legitimate rights available through a payment-card issuer, financial institution, or applicable law.

We reserve the right to provide applicable order confirmations, communications, receipts, pickup records, photographs, policies, and other relevant documentation in response to a payment dispute or chargeback.

20. Limitation of Responsibility

To the fullest extent permitted by applicable law, Kangan’s Bakery is not responsible for loss or damage caused by circumstances outside our reasonable control or by a customer’s failure to follow provided transportation, storage, handling, or care instructions.

Nothing in these Terms excludes, restricts, or waives liability or a consumer right that cannot lawfully be excluded, restricted, or waived.

21. Texas Law and Venue

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.

Subject to applicable jurisdiction and venue laws, any legal proceeding arising from an order or these Terms shall be brought in a court of competent jurisdiction located in or serving Fort Bend County, Texas.

Nothing in this section prevents a consumer from exercising any right provided by applicable federal or Texas law.

22. Severability

If any provision of these Terms is determined to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted by applicable law, and the remaining provisions will continue in effect.

23. No Waiver

Kangan’s Bakery’s failure to immediately enforce any provision of these Terms does not waive our right to enforce that provision in the future.

24. Entire Agreement and Modifications

These Terms, the applicable order confirmation or invoice, and the policies expressly incorporated into these Terms constitute the agreement governing an order.

Order-specific written communications between Kangan’s Bakery and the customer, including emails or electronic messages confirming agreed changes, may supplement or modify the order-specific details.

No oral statement will modify a confirmed order unless subsequently acknowledged by Kangan’s Bakery in writing.

25. Changes to These Terms

Kangan’s Bakery may update these Terms from time to time.

Unless required otherwise by law, the Terms applicable to an order will be the version in effect when that order was confirmed.

By placing or confirming an order, submitting payment, paying a deposit, or checking the Terms & Conditions acceptance box during online checkout, you acknowledge that you have read and agree to these Terms & Conditions and our applicable Return Policy & Cake Care instructions.
